1. Introduction and acceptance of the Terms
These Terms and Conditions of Use (hereinafter, the "Terms") regulate access to and use of the website https://geekvibes.agency (hereinafter, the "Site") owned by Geek Vibes S. de R.L. de C.V., a commercial entity incorporated under Mexican law, with address at Circunvalación Poniente 149-B, Ciudad Satélite, Naucalpan de Juárez, State of Mexico, C.P. 53100 (hereinafter, "Geek Vibes" or "the Company").
Access to the Site or its use by any person (hereinafter, the "User") implies that the User acknowledges having read, understood and accepted these Terms in their entirety. If the User does not agree with any of the provisions contained in this document, they must refrain from using the Site.
Geek Vibes reserves the right to modify these Terms at any time, without prior notice, by publishing the updated version on the Site. Continued use of the Site after any modification constitutes acceptance of the modified Terms.
2. Purpose of the Site
The Site's main purpose is to:
• Present the services, products, capabilities and success cases of Geek Vibes and its business units (Geek Vibes, Geek Media, Geek Merch, Geek Studio and Geek Staff).
• Allow Users to contact Geek Vibes for commercial, professional or informational purposes.
• Distribute editorial, technical and educational content in the form of blog posts, case studies and downloadable resources.
• Facilitate voluntary subscription to Geek Vibes' newsletter.
• Serve as a meeting point between Geek Vibes and prospects, current clients, potential collaborators and the professional community in general.
3. Intellectual property
All Site contents, including but not limited to texts, images, photographs, graphics, illustrations, logos, brands, trade names, isotypes, animations, videos, source code, compiled code, interface designs, schemas, page structures, design systems, color palettes, custom typefaces and any other element that makes up the Site (hereinafter, the "Contents"), are the exclusive property of Geek Vibes or of third parties who have granted the corresponding licenses for their use.
The Contents are protected by Mexican and international intellectual property laws, including the Federal Copyright Law, the Federal Law for the Protection of Industrial Property and applicable international treaties.
3.1 Brands and distinctive signs
The brands "Geek Vibes", "Geek Media", "Geek Merch", "Geek Studio", "Geek Staff", the g> isotype and other distinctive signs that appear on the Site are property of Geek Vibes. Unauthorized use of these brands constitutes a violation of industrial property rights and will give rise to corresponding legal actions.
3.2 Content use limitations
The User is expressly prohibited from:
• Reproducing, copying, distributing, modifying, publishing, transmitting, selling, transferring or commercially exploiting the Site's Contents without prior written authorization from Geek Vibes.
• Performing reverse engineering, decompilation or disassembly of the Site's code or any software accessible through it.
• Using the Contents for purposes other than personal consultation or evaluation of Geek Vibes' services.
• Removing, altering or concealing any trademark, logo, copyright notice or other proprietary legend included in the Contents.
• Creating derivative works based on the Contents without express authorization.
3.3 Permitted use
The User may view, download and print Site Contents exclusively for personal, non-commercial use and provided that the integrity of the Contents is respected and authorship is correctly attributed to Geek Vibes. Citations of Contents in academic, journalistic or professional publications are permitted in accordance with the provisions of the Federal Copyright Law regarding citation.
4. Use of the Site
4.1 User conduct
The User commits to using the Site in accordance with the law, morality, good customs and these Terms. In particular, the User commits to refraining from:
• Using the Site for illicit, fraudulent or purposes contrary to these Terms.
• Engaging in activities that damage, overload, disable or deteriorate the Site or interfere with its use by other Users.
• Introducing or spreading computer viruses, trojans, worms, malicious code or any other system that may cause damage to Geek Vibes' or third parties' computer systems.
• Engaging in "scraping", "crawling" or automated extraction of Contents without prior written authorization from Geek Vibes.
• Impersonating another person or entity, including employees, executives or representatives of Geek Vibes.
• Collecting personal data of other Users or third parties without their consent.
• Using the Site to send unsolicited commercial communications (spam), unauthorized advertising or message chains.
4.2 Accuracy of provided information
When the User provides information to Geek Vibes through the Site's forms, other digital channels or any other means, they must do so truthfully, accurately, completely and in an up-to-date manner. The User is solely responsible for the accuracy of the information provided and for the consequences of providing false, inaccurate or outdated information.
5. Links to third-party sites
The Site may contain links to websites operated by third parties. These links are provided solely as a courtesy and to facilitate the User's access to additional information or services that may be of interest.
Geek Vibes does not control, supervise, guarantee or assume responsibility for the content, privacy practices, accuracy, legality, security or any other aspect of third-party sites linked from the Site. The inclusion of a link does not imply endorsement, recommendation or approval by Geek Vibes of the linked site, nor of the products, services, information or opinions contained in it.
The User's access to third-party sites is at their own exclusive risk. Geek Vibes recommends that the User review the terms and conditions and privacy policies of each third-party site before using them.
6. Contact forms and communications
The Site has forms through which the User can contact Geek Vibes, request information, schedule meetings, subscribe to the newsletter or initiate business processes.
6.1 Nature of communications
Sending a form or any other communication to the Site does not constitute a binding offer on the part of the User or acceptance by Geek Vibes. The formalization of any business relationship between Geek Vibes and the User requires the execution of a specific contract or express agreement between both parties through the corresponding formal channels.
6.2 Treatment of personal data
Personal data that the User provides through the Site's forms will be treated in accordance with Geek Vibes' Comprehensive Privacy Notice, available at https://geekvibes.agency/legales/privacidad. The User acknowledges having read and accepted the Privacy Notice before providing their personal data.
6.3 Response time
Geek Vibes commits to responding to communications received through the Site's forms within a reasonable timeframe, normally less than 24 business hours. Geek Vibes does not guarantee specific response times unless there is a contractual relationship with defined SLAs.
7. Site availability
Geek Vibes makes its best efforts to keep the Site available and operational 24 hours a day, 7 days a week. However, the Site's operation may be interrupted by technical reasons, scheduled maintenance, telecommunications network failures, cyberattacks, acts of force majeure or any other circumstance beyond Geek Vibes' reasonable control.
Geek Vibes does not guarantee the continuous availability of the Site and will not be responsible for damages or losses that could result from lack of availability, interruptions, technical failures or any other circumstance affecting the normal functioning of the Site.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE USE OF THE SITE IS AT THE USER'S ACCOUNT AND RISK. THE SITE AND ITS CONTENTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
Geek Vibes does not warrant:
• That the Site's Contents are accurate, complete, updated, uninterrupted, error-free or suitable for any specific purpose.
• That the Site meets all the User's specific requirements.
• That the servers that make the Site available are free from viruses, malicious code or other harmful components.
• That the results obtained from the use of the Site are reliable or truthful.
Notwithstanding the foregoing, Geek Vibes commits to correcting, to the extent of its ability, any errors or inaccuracies that are reported to it by Users.
8.1 Indirect damages
IN NO EVENT shall Geek Vibes, its affiliates, executives, employees, agents or providers be responsible for indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of information, business interruption or any other commercial loss, that could result from the use or inability to use the Site, even if Geek Vibes has been advised of the possibility of such damages.
8.2 Indemnification
The User commits to defending, indemnifying and holding harmless Geek Vibes, its affiliates, executives, employees, agents and providers from any claim, demand, damage, loss, liability, cost or expense (including reasonable attorney's fees) that arises from the User's use of the Site in violation of these Terms or applicable legislation.
9. Use by minors
The Site is directed at adults. Geek Vibes does not knowingly collect personal data from minors through the Site. In the event that a minor accesses the Site or provides personal data without the consent of their parents, guardians or legal representatives, such representatives must contact Geek Vibes at datos@geekvibes.agency to request the deletion of the corresponding information.
10. Modification of the Terms
Geek Vibes reserves the right to modify these Terms at any time, without prior notice to the User. Modifications take effect as of the date of publication on the Site. The current version of the Terms will always be available at https://geekvibes.agency/legales/terminos with the date of last update indicated on the first page.
It is the User's responsibility to review these Terms periodically to stay informed of modifications. Continued use of the Site after the publication of modifications constitutes tacit acceptance of the modified Terms by the User.
11. Termination
Geek Vibes reserves the right, at its sole discretion and without the need for prior notice, to suspend, restrict, deny or terminate the User's access to the Site, in whole or in part, in case of User non-compliance with these Terms, applicable legislation or for any other reason that Geek Vibes considers justified.
Termination of access to the Site does not exempt the User from compliance with obligations contracted prior to such termination.
12. Applicable law and jurisdiction
These Terms are governed by and interpreted in accordance with the laws in force in the United Mexican States.
For the resolution of any controversy, claim or conflict that could arise in relation to these Terms, the parties expressly submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction that could correspond to them by reason of their present or future domicile.

14. Final acceptance
The User acknowledges and declares that they have read these Terms in their entirety, understand their scope and accept them voluntarily. The use of the Site constitutes express acceptance of these Terms.
